4. Project Engagement & Payments

4.1 Project Start
A project begins only after:

  • Signed contract or acceptance of proposal
  • Initial payment (if applicable)
4.2 Payments
  • Payments must be made on time as per the agreement.
  • Delayed payments may result in paused services.
  • Hosting and API subscriptions are billed monthly or yearly.
4.3 Refunds
Due to the nature of digital services, all payments are non-refundable, unless stated otherwise.

5. Client Responsibilities

Clients must:
  • Provide accurate project requirements
  • Supply all necessary material (text, images, logins, APIs)
  • Approve deliverables on time
  • Maintain valid payment methods

6. Intellectual Property

6.1 Client Ownership
Upon full payment:
  • Final deliverables become the property of the client
  • Source code ownership depends on the agreement
6.2 Company Ownership
We retain:
  • Reusable code libraries
  • Internal tools
  • Frameworks and modules developed by Shark Clicks

7. Hosting & Security

For clients using Shark Clicks hosting:
  • We provide server configuration, monitoring, and security
  • We cannot guarantee 100% uptime
  • Clients are responsible for third-party services (AWS, Cloudflare, etc.)

8. WhatsApp Business API Terms

Clients using WhatsApp API agree that:
  • Meta verification requirements must be followed
  • Messaging quotas apply
  • WhatsApp policies must be respected
  • Misuse may result in account suspension

9. Service Availability

We strive for uninterrupted service, but we do not guarantee:

  • 24/7 website availability
  • Error-free operation
  • Future compatibility with third-party APIs

10. Limitation of Liability

Shark Clicks is not liable for:
  • Loss of data
  • Business interruption
  • Third-party platform failures
  • Payment gateway issues
  • WhatsApp API restrictions
  • Incorrect client-provided material

Total liability is limited to the amount paid by the client for the service in the last 3 months.

11. Termination

We may terminate a project or service if:
  • Payments are overdue
  • Terms are violated
  • Illegal or unethical activities are detected

Clients may terminate services by written notice.

12. Governing Law

These Terms are governed by the laws of the Arab Republic of Egypt.
